Swarm HQ LLC ("Swarm", "we", "us") provides the Swarm commission-tracking platform. This policy explains what we collect, why, and your choices. It covers swarmhq.app and app.swarmhq.app (the "Service").

Who controls the data

When a company uses Swarm, that company decides what information to put into the platform about its own business, employees, and customers — it is the "controller" of that data. Swarm acts as a "processor": we host and process that data to provide the Service on the company's behalf. One exception: mobile phone numbers submitted for text alerts and the SMS consent attached to them are collected by Swarm directly from the individual, and Swarm is the controller of that information. It is handled as described in "Text messages (SMS) and mobile information" below, which always controls for mobile information.

Information we collect

Account information — name, phone, email, company name, and login credentials (passwords are stored only as secured hashes, never in plain text). If you choose "Sign in with Google," we receive your basic Google profile (name, email, and profile photo).
Business data you provide — the sales, employees, payouts, and related records you or your CRM upload to run commissions, and any documents or photos you add.
Payment information — subscription payments are processed by Stripe. Your card or bank details go directly to Stripe; Swarm never stores your payment numbers.
Connection credentials — if you connect a CRM or email provider, those credentials are encrypted at rest and used only to provide the feature you set up.
Usage and device information — basic log data (IP address, browser type, timestamps, and actions) to operate, secure, and improve the Service.

How we use it

To provide, maintain, secure, and improve the Service.
To calculate commissions and generate the reports and emails you ask for.
To communicate with you about your account, support requests, billing, and important changes.
To detect, prevent, and respond to fraud, abuse, and security issues.
To comply with the law.

We do not sell your personal information, we do not share one customer's data with another, and we do not use your business data for advertising or unrelated products.

Text messages (SMS) and mobile information

If you opt in to text alerts, we send automated SMS notifications — for example, a text when a commission report is ready, or a payday submission reminder. Consent is optional and never required to use the Service; the opt-in is a separate choice you make in your account settings. We collect your mobile phone number only when you provide it in your account, and we use it solely to send the messages you signed up for.

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Sharing with subcontractors in support services, such as customer service and message delivery, is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties.
Message frequency varies with your company's pay schedule — typically 2 to 6 messages per month.

Reply STOP at any time to cancel, or HELP for help. You can also turn texts off in the app.

We share information only with service providers that help us run Swarm (for example, cloud hosting, our database host, Stripe for payments, email delivery, and error monitoring), bound to handle it on our behalf; with you and the users in your own company; and where required by law or to protect rights and safety. If Swarm is ever involved in a merger or acquisition, data may transfer as part of that transaction, subject to this policy. Mobile phone numbers and text-messaging consent are excluded from the sharing described in this section — see "Text messages (SMS) and mobile information" above, which always controls for mobile information.

Security

We use reasonable technical and organizational measures to protect data, including encryption of sensitive credentials at rest, encrypted connections in transit, access controls, and audit logging of changes. No system is perfectly secure, but we work to keep your data safe and to respond promptly to any issue.

Data retention

We keep your data for as long as your account is active and as needed to provide the Service. You can export your company's data at any time from within the app. After a subscription ends, your data remains available for export for 90 days; after that we may delete or anonymize it, except for copies held briefly in routine backups or as the law requires.

Your choices and rights

You can access, correct, export, or request deletion of your data. Where you are an employee or customer of a company that uses Swarm, please direct such requests to that company first, since it controls that data; we will support them in responding. This does not apply to text messaging: mobile phone numbers and SMS consent are collected by Swarm directly from you, so you never have to go through your employer for them. Reply STOP to any message, turn texts off in your own Swarm notification settings, or contact support@swarmhq.app. See "Text messages (SMS) and mobile information" below. Depending on where you live, you may have additional rights under laws such as the CCPA — contact us to exercise them.

Nevada residents

Swarm does not sell covered information as defined by Nevada law (NRS 603A). Nevada residents may still submit a verified opt-out request to support@swarmhq.app, which we will honor if our practices ever change.

Cookies

The Service uses only essential cookies — a session cookie that keeps you signed in and preferences you set. We do not use advertising or cross-site tracking cookies.

Children

Swarm is a business tool and is not directed to children under 13, and we do not knowingly collect their information.

Changes

We may update this policy. If we make a material change, we'll give reasonable notice. The "last updated" date above shows the current version.
